A Board of Zoning Appeals was established in accordance with Public Law 178 of the Acts of 1979 of the Indiana General Assembly. The board is composed of five members, all of whom shall be residents of the City of Warsaw, and none of whom shall hold other elective or appointive office, except that two of the five members shall be appointed from the City Plan Commission's citizen membership.
The Board of Zoning Appeals shall consist of five members, all of whom shall be residents of the City of Warsaw. Three appointments are made by the Mayor, with one being a Plan Commission member. One appointment by the Council is to be a non-Plan Commission member, and the Plan Commission makes one appointment from their own roster.
The BZA shall have the following powers and it shall be its duty to:

Hear and determine appeals from and review any order, requirements, decision or determination made by the Building Commissioner in the enforcement of City Code.

Hear and decide on permits for special exceptions, development plans or other uses upon which the board is required to act.

Authorize upon appeal in specific cases such variances from the terms of City Code, as will not be contrary to the public interest, where owing to special conditions, fully demonstrated on the basis of the facts presented, a literal enforcement of the provisions of the City Code will result in unnecessary hardship, and so that the spirit of the City Code shall be observed and substantial justice done.

The Board of Zoning Appeals meets in the City Council Chambers (302 E. Market Street) on the 4th Monday of each month at 7:00 PM -- when there is business to conduct.
